Professor Marina Pavlović has received a grant of $5,000 from the Foundation for Legal Research for her project entitled, “Morguard at Twenty: The Future of the ‘Real and Substantial Connection Test’.”
Prof. Pavlović will make a comprehensive and systematic study of the evolution and development of the real and substantial connection test for adjudicative jurisdiction since it was articulated by the Supreme Court of Canada in Morguard Investments Ltd. v. De Savoye in 1990. She intends to analyze and assess the courts’ approaches to the test and its implementation, and suggest prospects for law reform.
The proposed project will make a contribution to the scholarly literature in the field of conflict of laws.
